Terms of Use & Purchase Agreement

1. Agreement to Terms
These Terms of Use and Purchase Agreement ("Agreement") govern your purchase of and access to the Master Your Marketing Course ("Course"), offered by Buzz & Banter Studios ("Company," "we," "us," or "our"). "You" and "your" refer to the individual purchasing access to the Course.
By completing your purchase, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety. If you do not agree to these terms, do not complete your purchase or access the Course.
2. Course Overview
The Master Your Marketing Course is a self-paced digital course designed to help service-based entrepreneurs build and execute a customized marketing strategy. The Course includes:
Pre-recorded training modules organized across three phases: The Foundation, Needle-Moving Tactics, and Make It a Reality
Supplemental resources, guides, homework assignments, and marketing audits
Guest expert training sessions covering topics including content marketing, email marketing, social media, client experience, and networking
Exclusive vendor recommendations curated by Buzz & Banter Studios
Quarterly content updates to keep course materials current and relevant
Course content is delivered through ThriveCart. Access instructions will be provided following purchase.
3. Payment Terms
The Course is available for purchase at the following price points:
$697 paid in full
2 payments of $373.50
All payments are processed securely through Stripe. By completing your purchase, you authorize Buzz & Banter Studios to charge the payment method on file for the applicable amount.
If you select the split payment option, you authorize two charges to your payment method on the schedule presented at checkout. It is your responsibility to ensure your payment method remains valid for both payments. Failure to complete your second payment does not relieve you of your payment obligation. If a payment is declined and not resolved within five (5) business days, we reserve the right to suspend your Course access until the balance is paid in full.
4. No Refund Policy
ALL SALES ARE FINAL. We do not offer refunds for any reason, including but not limited to:
Failure to complete the Course or any portion of it
Dissatisfaction with the Course content or delivery
Personal or business circumstances that prevent participation
Failure to achieve specific results or outcomes
By completing your purchase, you acknowledge that you have reviewed the Course details, pricing, and this Agreement in full and understand that no refunds will be issued under any circumstances. If you are on a split payment plan, you remain obligated to complete all scheduled payments regardless of whether you continue to access or engage with the Course.
5. Course Access and Lifetime License
Upon purchase, you are granted a limited, non-exclusive, non-transferable, personal license to access and use the Course materials for your own business and educational purposes. This license is granted for the lifetime of the Course, meaning for as long as Buzz & Banter Studios actively maintains and offers the Course.
While we intend to make the Course available indefinitely, we do not guarantee perpetual availability. In the event we discontinue the Course, we will make reasonable efforts to provide advance notice to enrolled students.
Your access is individual and non-transferable. You may not share your login credentials, provide access to any other person, or allow anyone else to use your account to access the Course.
6. Guest Expert Content
The Course includes training sessions featuring guest experts covering a range of marketing-related topics. Guest expert content represents the views, opinions, and expertise of the individual presenters and does not constitute legal, financial, medical, or other professional advice.
Buzz & Banter Studios curates guest experts with care but is not responsible for the accuracy, completeness, or outcomes of guest expert sessions. Guest expert availability, session topics, and featured contributors are subject to change at our discretion. Changes to guest expert content do not entitle you to a refund or any other compensation.
7. Quarterly Content Updates
We are committed to keeping the Course relevant and up to date. We provide quarterly reviews of Course content and update materials as needed to reflect current marketing best practices. The specific scope, timing, and nature of updates are at our sole discretion. Updates are included in your purchase at no additional cost and do not alter the terms of this Agreement.
8. Intellectual Property
All Course content, including but not limited to training videos, written materials, frameworks, templates, resources, audits, homework assignments, guest expert recordings, and any other materials provided through the Master Your Marketing Course (collectively, "Course Content"), is the proprietary intellectual property of Buzz & Banter Studios and is protected by applicable copyright, trademark, and intellectual property laws.
Your purchase grants you a personal license to access and use the Course Content for your own business purposes only. You may not:
Copy, reproduce, distribute, or share any Course Content with any person who has not purchased the Course
Sell, license, sublicense, or otherwise commercialize any Course Content
Use Course Content to create, develop, or deliver a competing course, program, or product
Screenshot, record, download, or otherwise capture Course Content for purposes beyond your personal use
Remove, alter, or obscure any copyright, trademark, or attribution notices on any Course Content
Violation of this section may result in immediate revocation of your Course access without refund and may expose you to legal liability.
9. No Guarantee of Results
Participation in the Master Your Marketing Course does not guarantee any specific business, financial, or marketing outcome. Results vary based on individual effort, implementation, industry, market conditions, and many other factors outside our control.
Any testimonials, case studies, or examples shared in connection with this Course represent individual experiences and are not guarantees of similar results. You are solely responsible for your own business decisions and their outcomes. Nothing in this Course constitutes legal, financial, or professional advice.
10. Disclaimer and Limitation of Liability
THE COURSE AND ALL COURSE CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE FULLEST EXTENT PERMITTED BY LAW, BUZZ & BANTER STUDIOS AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PURCHASE OF OR PARTICIPATION IN THE COURSE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, BUSINESS OPPORTUNITIES, OR DATA.
THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE COURSE.
11. Indemnification
You agree to defend, indemnify, and hold harmless Buzz & Banter Studios, its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Course, your violation of this Agreement, or your violation of any applicable law or third-party rights.
12. Termination and Revocation of Access
We reserve the right to revoke your access to the Course at any time without refund if you:
Violate any provision of this Agreement
Share, distribute, or otherwise misuse Course Content in violation of Section 8
Engage in conduct that we determine, in our sole discretion, to be harmful to the Company or any third party
13. Modifications to the Course
We reserve the right to modify, update, restructure, or discontinue any portion of the Course, including content, delivery platforms, guest expert sessions, and included resources, at any time. We will make reasonable efforts to notify enrolled students of material changes. Modifications do not entitle you to a refund or any other compensation.
14. Testimonials and Marketing Use
If you submit a review, testimonial, or feedback about your experience with the Course, you grant Buzz & Banter Studios a non-exclusive, royalty-free, perpetual, and worldwide license to use your submission for marketing and promotional purposes, including but not limited to social media, the Company website, sales pages, and advertising materials.
You may choose to submit your review anonymously, in which case your name and identifying business information will not be used in connection with your testimonial. Non-anonymous submissions may be featured with your first name, business name, and any other information you voluntarily provide.
You represent and warrant that any review or testimonial you submit is truthful, based on your genuine experience, and does not infringe on any third party's rights.
15. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Idaho, without regard to conflict of law principles.
In the event of any dispute arising out of or related to this Agreement or the Course, you and the Company agree to first attempt informal resolution by contacting nikki@buzzandbanterstudios.com. If the dispute is not resolved within thirty (30) days, it shall be submitted to binding arbitration in Ada County, Idaho, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
Each party waives the right to bring claims as a plaintiff or class member in any class action proceeding.
16. Severability
If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be modified. All remaining provisions shall remain in full force and effect.
17. Entire Agreement
This Agreement constitutes the entire agreement between you and Buzz & Banter Studios with respect to your purchase of and access to the Master Your Marketing Course and supersedes all prior agreements, representations, or understandings, whether written or oral. We reserve the right to update this Agreement at any time. Continued access to the Course following notice of any changes constitutes your acceptance of the revised terms.
